The State Consumer Disputes Redressal Commission (SCDRC) handles consumer complaints involving higher claim values as prescribed under the Consumer Protection Act, and also hears appeals from District Commissions. It functions as a key authority for resolving disputes related to defective goods, deficient services, and unfair trade practices. Below is an overview of the typical procedure before the SCDRC:
The process begins when the consumer files a complaint or appeal before the SCDRC, supported by bills, agreements, warranties, medical records (if applicable), and other relevant evidence.
The Commission reviews the complaint for jurisdiction, valuation, and legal compliance. If found in order, it is formally admitted for proceedings.
Notices are issued to the opposite party (company, dealer, hospital, bank, builder, etc.) requiring them to reply to the allegations within a specified timeframe.
Both parties exchange written submissions, supporting documents, expert reports, and other evidence to establish facts and address the dispute.
The Commission conducts hearings where both sides present their case, clarify issues, and argue on points of law and consumer protection.
The Commission may grant temporary relief such as halting unfair practices, safeguarding consumer interests, or preserving goods in question until the final order.
After evaluating the evidence and arguments, the SCDRC delivers its final decision, which may include compensation, refund, replacement, damages, or corrective measures.
If the opposite party does not comply with the order, the complainant may initiate execution proceedings to enforce the judgment.
Aggrieved parties may challenge the SCDRC’s decision before the National Consumer Disputes Redressal Commission (NCDRC) for further review.
